Monash-Conference-Net Terms of Use

By using Monash-Conference-Net ("the Wireless"), you are agreeing to the following terms of use, which constitute an agreement between Monash University and you ("the Agreement").

Wireless Service

The Monash Conference-Wireless-Net service allows you to connect your equipment to the Internet. The Wireless has an open architecture and the Wireless should be regarded by you as a hostile security environment. You are responsible for taking the appropriate measures to protect your data, privacy and equipment when using the Wireless.

The Wireless is part of the IT systems of Monash University and you are required to comply with all policies of Monash University including but not limited to the Acceptable use of information technology facilities by students and IT Use Policy - Staff & Other Authorised Users, even if you are neither staff or student of Monash University .

You acknowledge and agree that peer to peer file sharing is strictly prohibited on the IT systems of Monash University.

Monash University reserves the right, at its absolute discretion, to terminate your use of the Wireless.

No Warranties

The Wireless is provided on an 'as is' and 'as available' basis. Monash University hereby excludes any warranty either express or implied as to the security, merchantability, fitness for purpose, accuracy, currency, availability or comprehensiveness of the Wireless. To the fullest extent permitted by law, the liability of Monash University under any condition or warranty which cannot be excluded legally is limited, at the option of Monash University, to supplying the services again or paying the cost of having the services supplied again.

Limitation of Liability

Monash University accepts no responsibility for loss or damage arising from the use of its IT systems including the Wireless.

Notwithstanding any other section of this Agreement and to the fullest extent permitted by law, Monash University's liability arising from or in connection with the performance or non-performance of any or all of its obligations under this Agreement or in any manner related to this Agreement (and whether in tort, for breach of contract, breach of statute or otherwise) will not in the aggregate exceed ten Australian dollars.

Laws That Govern This Agreement

This Agreement is governed by and construed in accordance with the laws of the State of Victoria, Australia.

Acceptance Procedure

By using the Wireless, you agree with all the terms and conditions of this Agreement.

We reserve the right, at our sole discretion, to change the terms and conditions of this Agreement from time to time, and your continuing use of the Wireless constitutes your acceptance of, and agreement to, any changed terms and conditions.
